SMA Emergency Permit

Purpose:


The Director or Planning may issue a Special Management Area (SMA) Emergency Permit (SM3) under specific conditions as outlined in Hawaii Revised Statues, Section 205A and Maui, Molokai or Lanai Planning Commission Special Management Area Rules. AN EMERGENCY EXISTS WHEN there is an imminent threat to a legally habitable structure, or when public infrastructure is at risk of failure which would substantially affect public health and safety.

How To Apply:

Complete the appropriate SMA Emergency Permit application packet and submit to the

Department of Planning. A Zoning & Flood Confirmation Form must be completed and signed by the Department of Planning prior to submittal Fill in the project identification portion of the form and submitting it to the Zoning Administration and Enforcement Division at One Main Plaza Suite 335.  The zoning and flood designations are confirmed and then returned to the applicant for inclusion in the SM3 packet.
