SMA Use Permit

Purpose:


The purpose of the Special Management Area Use permit is to regulate any use, activity, or operation that qualifies as "development", and has a total cost fair market value of $500,000 or more; or has significant adverse environmental or ecological effect within the Special Management Area.

How To Apply:

Complete the appropriate Special Management Area Permit Application packet and submit it to the Department of Planning. A  Zoning & Flood Confirmation Form must be completed and signed by the Department of Planning prior to submittalFill in the project identification portion of the form and submitting it to the Zoning Administration and Enforcement Division at One Main Plaza Suite 335.  The zoning and flood designations are confirmed and then returned to the applicant for inclusion in the SMA packet.  

Approving Agencies:

Appropriate Planning Commission.

Duration of Approval:

No expiration. However, approvals often expire if construction is not started by the deadline stated in the permit.

Fees:

Non-refundable filing fee (see Fee Schedule, Table A) payable to "County of Maui, Director of Finance".
